These Terms and Conditions govern your use of Rosewood Manor's website and the provision of our senior care services. By accessing our website or entering into a service agreement with Rosewood Manor, you agree to be bound by these terms.

Please read these terms carefully before using our services or website. If you do not agree with any part of these terms, please do not use our website or services.

Definitions

For the purposes of these Terms and Conditions:

  • "Facility" refers to Rosewood Manor, the residential care facility located at 5620 Marine Drive, West Vancouver, BC V7W 2R6.
  • "Services" means the senior care services provided by Rosewood Manor, including full care residence, couples accommodation, and adult day program.
  • "Resident" refers to any individual receiving care services at our facility.
  • "Responsible Party" means the individual or individuals who enter into the service agreement on behalf of a resident, including family members or legal representatives.
  • "Agreement" refers to the service agreement entered into between Rosewood Manor and the responsible party.
  • "Website" refers to the Rosewood Manor website located at rosseewoodmajd.sbs.

Use of Services

Eligibility

Our services are available to seniors requiring residential care or day program support. Admission decisions are made based on assessment of care needs, facility capacity, and ability to appropriately meet the individual's requirements. We reserve the right to decline service if we determine we cannot safely or appropriately meet someone's care needs.

Service Agreement

Before receiving services, residents or their responsible parties must complete and sign a service agreement outlining the scope of care, fees, and terms. This agreement becomes legally binding upon signature and payment of required deposits or initial fees. The agreement specifies care levels, accommodation details, payment terms, and responsibilities of all parties.

Accuracy of Information

Responsible parties must provide accurate and complete information during the assessment and admission process, including medical history, care needs, emergency contacts, and financial information. Failure to provide accurate information may affect our ability to provide appropriate care and may result in modification or termination of services.

Prohibited Uses

You may not use our website or services:

  • In any way that violates applicable federal, provincial, or local laws or regulations
  • To transmit any harmful code, viruses, or malicious software
  • To impersonate Rosewood Manor staff or misrepresent your relationship with our facility
  • To harass, threaten, or harm other residents, visitors, or staff members
  • To engage in any conduct that restricts or inhibits anyone's use of the website or that may harm Rosewood Manor or our users
  • To collect or store personal data about other users without their consent
  • For any commercial purposes not authorized by Rosewood Manor

Intellectual Property

The content on our website, including text, graphics, logos, images, and software, is owned by Rosewood Manor and protected by Canadian copyright and trademark laws. You may view and print content from our website for personal, non-commercial use only.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our website without our express written permission.

Payment Terms

Fees and Billing

Monthly fees for residential care services are due on the first day of each month. Adult day program fees are billed monthly based on days attended. All fees are stated in Canadian dollars (CAD). Payment may be made by cheque, bank transfer, or other agreed-upon methods.

Fee Changes

We reserve the right to adjust fees with 60 days written notice. Fee changes may reflect increased operating costs, changes in care requirements, or adjustments to service levels. Current rates are available upon request and are outlined in individual service agreements.

Late Payment

Payments not received within 10 days of the due date may be subject to late fees. Continued non-payment may result in suspension or termination of services. We will work with families experiencing financial difficulties to establish payment arrangements when possible.

Deposits

A deposit equivalent to one month's fees may be required before admission. Deposits are held for the duration of the service agreement and applied to the final month of care or refunded following departure, less any outstanding charges.

Refund Policy

Monthly fees are pro-rated for partial months based on days of service provided. If a resident departs mid-month, fees are calculated from the first day of the month through the departure date. No refunds are provided for days when a resident is absent due to hospitalization or temporary leave, as accommodation remains reserved.

For the adult day program, fees are charged only for days attended. There are no refunds for scheduled days when the participant is absent unless cancellation occurs more than 24 hours in advance.

Disclaimers and Limitations of Liability

Services Provided "As Is"

While we strive to provide high-quality care, we cannot make absolute assurances about outcomes. Care is provided based on current professional standards and resident needs as assessed by our team. Individual responses to care vary, and we cannot provide guarantees regarding health improvements or specific results.

Limitation of Liability

To the extent permitted by law, Rosewood Manor shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our services or website. Our liability is limited to the amount of fees paid for services during the preceding month.

Health Risks

Residents and their families acknowledge that senior care involves inherent risks, including but not limited to falls, illness, and changes in health status. While we implement safety measures and provide appropriate supervision, we cannot eliminate all risks associated with aging and health conditions.

Force Majeure

Rosewood Manor shall not be liable for failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, pandemics, government orders, utility failures, or other force majeure events. We will make reasonable efforts to continue providing care during such events while prioritizing resident and staff safety.

Termination of Services

Voluntary Departure

Residents or their responsible parties may terminate services by providing 30 days written notice. Fees are pro-rated through the departure date. Upon departure, personal belongings must be removed within 48 hours unless alternative arrangements are made.

Facility-Initiated Termination

We may terminate services with 30 days notice if a resident's care needs exceed what we can safely provide, if behavior poses safety risks to others, or if payment obligations are not met. In cases of immediate safety concerns, we may require immediate departure with assistance in finding alternative arrangements.

Effects of Termination

Upon termination, all outstanding fees must be paid. Deposits will be refunded less any charges for damages beyond normal wear or unpaid fees. Care records will be provided to new care providers as authorized by the resident or responsible party.

Dispute Resolution

Informal Resolution

Before pursuing formal dispute resolution, parties agree to attempt to resolve disagreements through direct communication with facility management. Most concerns can be addressed through conversation and collaborative problem-solving.

Mediation

If informal resolution is unsuccessful, parties agree to participate in mediation before pursuing legal action. Mediation costs will be shared equally unless otherwise agreed.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of British Columbia and the federal laws of Canada applicable therein. Any legal proceedings must be brought in the courts of British Columbia, and parties consent to the jurisdiction of those courts.

General Provisions

Entire Agreement

These Terms and Conditions, together with the service agreement and any addenda, constitute the entire agreement between parties and supersede all prior understandings or agreements regarding the subject matter.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

No Waiver

Failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations with notice to you.

Notices

Notices required under these terms must be provided in writing to the addresses specified in the service agreement or to the contact information below.

Changes to These Terms

We may update these Terms and Conditions periodically. Changes become effective upon posting to our website unless otherwise specified. Material changes will be communicated to current residents and their responsible parties with reasonable notice. Continued use of services following changes constitutes acceptance of modified terms.
